How much does bail cost in Illinois?

Table of Content

Some of the most common questions about security deposits are:

    • Do you get your security deposit back in Illinois?
    • What happens when you break a bond?
    • Does Illinois have bail bonds?
    • Can you get out of prison in IL=llinois?
    • How long does it take to get your bail money back in Illinois?

How to get your bail money back:

Once your case is closed, your bail money will be returned to you (minus 10% if your bail is a “Bond D”). If you have fines, court costs, or other charges, the court will apply your bail refund to the amount you owe the court before returning your bail. Your deposit can (in some cases) be used to pay your solicitor. Some courts are more willing than others to refer the bail back to your attorney.

How Bail is Set The judge will consider many factors when determining the type and amount of bail an individual should be given. The judge first considers the nature of the crime or the charges against the accused. The judge will also consider whether someone was injured during the crime or whether it was a robbery, how much money or stolen property was stolen. Other factors that go into determining a connection include: age, education, employment status, marital status, the person’s place of birth, how long he or his family has lived nearby. The judge will determine whether the defendant has “significant ties” to the area before setting the bail amount.

    Illinois Bail Guide

Under Illinois law, you cannot breach the terms of your bail. If you do, it’s a Class 4 felony (if it’s your first offense) and a Class 3 felony if it’s your second or subsequent offenses.

    Illinois Bail Rules

There are different types of bails, which may vary depending on the court pending. There are three types of bonds in Cook County.

    They are:

    • I Bond. The person is released at his own risk and promises to come back for all hearings.
    • D Bond. This allows the payment of 10% of the deposit amount. Cook County will retain this fee as a processing fee regardless of the outcome of the case.
    • C Bond. This is the full cash payment of the bond. The full amount will be refunded when the person appears in court (minus any fees, depending on the outcome of the case).

    Determining the Deposit

The deposit schedule is different in each state and county. For example, if a person is arrested for assault/domestic violence in San Bernardino County, the bond may be different than in Orange County. The amount of bail depends on several factors and is determined when the defendant first appears in court.

Additionally, personal injury bail ranges from $1,000 to $100,000 in San Diego County, up to $20,000 in Riverside County, and up to $25,000 in Orange County.
