This is not a new trend, however. The state of Texas is more than fortunate to have people behind bars – Texas has more inmates behind bars than any other state in the country. Texas state prisons are already full of people serving time.
There is much debate these days about how to deal with the fact that Texas has a skyrocketing prison population. And hopefully some answers will be found, and soon, because at this point it makes a very good argument that being incarcerated in a Texas state penitentiary is a cruel and unusual punishment.
You are NOT required to take the Texas standardized sobriety tests
Although the officer may pretend that you should take the tests, do not. If he asks you to get out of the vehicle, then you should get out of the car. But once he tries to start the HGN (eye test) on you, you can (and should) politely decline the test. Notice what I said… Politely decline.
Don’t be an idiot and rant about how you read this blog knowing these tests are useless and you refuse to take them. Remember that all of this is captured on audio and video; Audio and video that will be exhibit #1 in a trial if it goes that far. Just let the officer know you don’t want to take standardized sobriety tests.
Yes, you can (and probably will) be arrested if you refuse to take the FST. If the officer already felt they had enough evidence to manage the evidence, they will likely arrest you for DWI if you refuse to take it. But hey, you’d probably get arrested anyway. But now there will be less evidence against him. You have the absolute right not to testify against yourself. This fundamental right also applies in the context of DWI.
Aggravated State Prison Sentence
A criminal record or other circumstances may result in a state prison crime being treated as a third-degree felony.
- Whether a person was convicted of a state prison felony prior to the new charge;
- When a person uses or displays a deadly weapon while committing the state prison felony;
- When a person uses or displays a deadly weapon while fleeing immediately after committing a state prison felony;
- When a person is a “party” to a state prison crime and knew that a deadly weapon would be used or displayed;
- When a person has been convicted of continued human trafficking;
- When a person has been convicted of continued sexual abuse of a child; or
- When a person has been convicted of a so-called 3g crime.

The Bureau of Prisons (BOP) maintains records of federal prisoners released after 1982. You can use the Inmate Locator to find out when an inmate has been released or is expected to be released. For more information about an inmate, submit a Freedom of Information Act request to the BOP.
Good time credit can be calculated by multiplying 10 years by 54 working days per year (540 days) and then adding the additional 4 months of credit (54 days per year divided by 12 months = 4.5 days per month ) , which equals 18 days (4 times 4.5).
